These Terms govern your use of the Lume app ("Lume", "we", "our"). By creating an account or using Lume you accept these Terms. If you do not accept, please delete the app.

1. Who May Use Lume

You must be at least 13 years old.
If you are between 13 and 17, you must have permission from a parent or guardian.
You must have the legal capacity to enter a binding contract in your jurisdiction.
You must not use Lume if you are on a US or UN sanctions list.

2. What Lume Is — and Isn't

Lume is a self-help / emotional wellness app that uses an AI assistant to help you reflect on feelings, log moods, and practice mindfulness techniques.

Lume is NOT:

a medical device, diagnostic tool, or substitute for therapy;
a crisis or suicide prevention service;
a HIPAA-covered health provider;
a substitute for talking with a licensed mental health professional.

If you are in crisis, please contact 988 (US Suicide & Crisis Lifeline) or your local emergency services. Do not rely on Lume or any AI for emergency help.

3. Your Account

You are responsible for keeping your login credentials secure.
You are responsible for all activity under your account.
Notify us immediately if you suspect unauthorized access.
One account per person. Don't create fake accounts or impersonate others.

We may suspend or close accounts that violate these Terms, attempt to defraud the service, abuse other users, or pose a risk to the service.

4. Acceptable Use

Do NOT use Lume to:

harass, abuse, threaten, or harm other people;
share content that is illegal, defamatory, obscene, or infringing;
attempt to reverse-engineer, scrape, automate, or overload the service;
bypass usage limits, free trials, or payment;
upload malware or exploit security flaws;
generate content that is illegal in the United States (e.g. CSAM, targeted harassment, credible threats).

Violations may result in immediate termination and, where legally required, reporting to authorities.

5. AI Content Disclaimer

Lume's AI replies are machine-generated based on statistical models. They may contain factual errors, inappropriate tone, or advice that is not right for your situation. You are responsible for how you interpret and act on any AI output. Do not use AI responses for medical, legal, or financial decisions.

6. Your Content

You retain ownership of everything you create in Lume — moods, notes, conversations, feedback. By using Lume, you grant us a limited license to store, process, and display your content back to you, and to pass chat messages to AI providers (see Privacy Policy §3) for the sole purpose of operating the service.

We don't use your personal content to train AI models.

7. Subscriptions and Payments (when enabled)

Lume offers optional paid subscriptions (monthly or yearly).

Free trial: a 7-day free trial may be offered on first purchase. You will not be charged until the trial ends. You can cancel during the trial in your Apple ID / Google Play settings.
Auto-renewal: subscriptions auto-renew unless cancelled at least 24 hours before the current period ends. Apple/Google bills the renewal.
Refunds: refund requests are handled by Apple or Google per their standard policies. We generally cannot refund on their behalf.
Price changes: we may change prices with 30 days notice for existing subscribers (or as required by Apple/Google).

8. Termination

You may delete your account at any time via Profile → Delete Account.

We may terminate or suspend your access immediately if you violate these Terms, abuse other users, create security risks, or fail to pay fees.

After termination, your data is deleted per the Privacy Policy §5. Some provisions (disclaimers, limitation of liability, indemnification, governing law) survive termination.

9. Disclaimers

Lume is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant the service will be uninterrupted, error-free, secure, or that AI replies will be accurate, safe, or helpful.

10. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data.
Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.

Some jurisdictions do not allow these limitations; in that case they apply to the extent permitted by law.

11. Indemnification

You agree to defend and indemnify us (and our affiliates, employees) from any claims arising out of your misuse of Lume or violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

Any dispute that is not resolved informally will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, in English, seated in Delaware. You waive the right to a jury trial and to participate in class actions. You may opt out of arbitration within 30 days of creating your account by emailing us with subject "Arbitration Opt-Out".

Small-claims court actions are allowed as an alternative.

13. Changes to These Terms

We may update these Terms. For material changes we will notify you in-app and update the effective date. Continued use after changes means you accept the updated Terms.
